A good news for the people who have been waiting for Samram for two decades is that the government will implement a new way of land transfer to regularize over 40 lakh properties by Diwali, preparation for official stamp.

INDIA/BENGALURU: The state government is gearing up to give good news by Diwali to people who have been waiting for nearly 20 years to build houses on revenue plots. The government has sought a new way to regularize over 40 lakh unauthorized houses, plots and other properties in revenue areas across the state, including Bengaluru. For transparency in land transfer, the government intends to regularize the properties of revenue estates in a new system to be implemented through an ordinance.

The government has decided to issue an ordinance to bring transparency in the process by limiting the period for conversion of agricultural land to non-agricultural purpose to 7 days. A copy of the order has already been prepared to allow owners of plots and houses already constructed illegally to apply for land transfer with penalty fee. An ordinance in this regard will be issued by Diwali.

The case in the Supreme Court has blocked the government’s plan to implement the illegal scheme before the assembly elections. Therefore, the government has to collect a large amount of revenue in the form of fines. In order to give peace of mind to the people who have bought plots and houses in areas where land has not been transferred, their properties should be properly stamped. Sources in the revenue department said that through this, it has been calculated that there should be a way to get bank loan facility for building houses and other works.

What is an Ordinance?:
There is a complaint that there is a problem in transferring the land due to delay and corruption. Therefore, the Act is amended so that transfer of land can be done within 7 days of submission of the relevant documents along with the prescribed fee. A maximum of 7 days is fixed for land transfer in urban areas with master plan and 30 days in rural areas without master plan.

If approval is not obtained from the Collector concerned within the specified time, the land transfer request will be automatically approved with the digital signature of the Collector concerned. A self-attestation affidavit is also obtained along with the land transfer application. A declaration that the concerned property has not been acquired for various purposes of the Government and is not subject to the ambit of the PTCL Act should also be given along with the application. If the applicant provides false or incorrect information, the fee paid for land transfer will be forfeited.

How illegal – legal?

A simple, transparent, people-friendly system is being implemented to allow conversion of agricultural land to non-agricultural purposes within a one-week deadline of application. An amendment bill has been prepared in this regard and it has been decided to implement it through an ordinance. It is the intention of the Government to provide an opportunity to the holders of houses and plots without authorization to apply for conversion of plots. Lands and houses in revenue estates will be stamped once the Collector concerned approves the transfer request.

Technical power

The newly implemented Kaveri-2 software for property registration by the state government will provide clear details of land records. Once the Collector approves the land transfer request, all the details will be obtained by checking the survey number of the concerned property. If the land to be acquired is owned by Govt or Scheduled Community, details are available in this software. Thus, it was decided to settle the land transfer applications within 3 days of application. However, Revenue Minister R. Ashok said that 7 days has been given as the Collector requested that there is no time limit.

An ordinance has been issued fixing a period of 7 days for conversion of agricultural land to land for non-agricultural purposes. With this, it is hoped that lakhs of people who have been waiting for implementation of the illegal-legal scheme will get relief. Revenue Minister R. said that the sweet news will be given by the decree by Diwali. Ashok said.
